Spotto Pty Ltd (ABN pending) ("Spotto", "we", "our", "us") operates a two-sided marketplace that connects drivers seeking short-term parking ("Drivers") with property owners who list parking spaces ("Owners") through the Spotto mobile application and associated services.
By creating an account or using the Spotto app, you agree to be bound by these Terms & Conditions and our Privacy Policy.
You must be at least 18 years old and a resident of Australia to use Spotto. By registering, you represent that you meet these requirements and that all information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@spottoplatform.com.au if you suspect any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Owners represent that they have the legal right to sub-let or grant access to the parking space they list. Owners must ensure their listings are accurate, including location, pricing, availability, and access instructions.
Spotto does not verify ownership or legal title to any property. Owners are solely responsible for complying with strata by-laws, body corporate rules, council regulations, and any other applicable laws.
All payments are processed securely through Stripe. Owner payouts are handled through Stripe Connect to the connected bank account after eligible bookings are completed.
Prices displayed in the app are in Australian Dollars (AUD) inclusive of GST where applicable.
Drivers may cancel a booking up to 24 hours before the scheduled start time for a full refund. Cancellations made within 24 hours of the booking start time are non-refundable.
If an Owner cancels a confirmed booking, the Driver will receive a full refund. Repeated cancellations by an Owner may result in account suspension.

Spotto is a marketplace platform only. We are not responsible for the condition of any parking space, any damage to vehicles, or any disputes between Drivers and Owners.
To the maximum extent permitted by Australian Consumer Law, Spotto's total liability is limited to the amount paid by you in the 3 months preceding the claim.
Our Privacy Policy explains how we collect, use, and protect your personal information. By using Spotto, you consent to our data practices as described in that policy.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
